CORVUS achieves a favorable outcome for the client in a public procurement dispute

We are pleased with the achievement of our firm’s attorneys – attorney-at-law Andrejs Voroncovs and assistant to attorney-at-law Jānis Maulis – who successfully represented the client before the Procurement Monitoring Bureau in a dispute concerning the contracting authority’s decision in a construction supervision procurement worth more than half a million euros, ensuring that the contracting authority’s decision to conclude the contract with the winning tenderer, our firm’s client, remained in force.

🔍 The dispute centered on the question of interpreting the provisions of the Public Procurement Law regarding the provision of additional information to the contracting authority during the evaluation of tenders – to what extent the additionally provided information is to be regarded as a permitted clarification of the tender, or already as an impermissible modification of the tender.

⚖️ The Public Procurement Monitoring Bureau recognized that the content of the tender had not been modified, but that during the evaluation of the tender the winning tenderer, by submitting the additional information requested by the contracting authority, had only clarified information already contained in the tender, and dismissed another tenderer’s complaint as unfounded, allowing the contracting authority to conclude the contract with our client.

This case vividly affirms the competence of the CORVUS team in the field of public procurement and the ability to defend clients’ interests even in technically complex and legally contentious proceedings.
