đšÂ CORVUS secures a favorable outcome in a complex and long-standing construction dispute
We are proud to share a significant achievement by the CORVUS Legal team – attorney-at-law Andrejs Voroncovs and assistant to attorney-at-law JÄnis Maulis, have successfully represented the client in a complex dispute with Riga City’s Municipality Department of City Development over a neighboring construction project that would have reduced sunlight access (âď¸ insolation) to apartments in the clientâs residential building.
đ The key issue in the case was whether environmental variables must be considered when calculating insolation impacts during new construction planning. The matter proved technically and legally challenging, requiring input from the Ekonomikas ministrija/ Ministry of Economics and other experts and led to more than ten years of litigation.
đď¸ Thanks to CORVUSâs persistent legal strategy, the owner of the neighboring plot agreed to reduce the planned building height from six to four storeys, avoiding adverse effects on the clientâs property.
â ď¸ Another core issue involved the correct interpretation of the Administrative Procedure Law: how to terminate legal proceedings when, during litigation, the contested part of a building permit is removed by the authority at the permit holderâs request. Here, too, CORVUS ensured that the case was closed based on the most favorable legal standard for the client.
